Terms & Conditions: Artist

Upon form submission, artists are acknowledging acceptance of the following terms and conditions:

§1 TERMS OF AGREEMENT

This event is open to artists globally. Artists are eligible to submit one piece of their own artwork. The sales agreement comes into effect when Openhalle successfully auctions the artwork. Until a sale is finalised, the artwork remains in the artist’s possession unless selected for physical exhibition. Should a sale occur, Openhalle will retain a commission of 50% of the final price.

§2 SUBMISSION REQUIREMENTS

  • Entry Fee: Artists are invited to submit an artwork subject to a non-refundable entry fee of ten euros (€10).
  • Size Restrictions: Any artwork with a dimension exceeding 80 cm will be eligible for online presentation only, unless otherwise specified by special invitation. For these larger works, a high-quality photograph is sufficient for submission and presentation.
  • Submission Accuracy and Approval: Artists are responsible for ensuring all submitted information is accurate. Selection will be based on high-quality digital images. Openhalle reserves the right to refuse an artwork upon physical inspection only if it is in poor condition, damaged in transit, or was significantly misrepresented in the submission materials.

§3 ARTIST RESPONSIBILITIES

Artists affirm that their submitted artwork is an original creation by them and that it neither infringes upon the rights of any third party nor has any undisclosed defects. All artworks on paper must be framed professionally at the artist’s expense.

§4 DELIVERY AND RETRIEVAL OF ARTWORK

Selected artists are responsible for delivering their artwork to Openhalle by the specified due date, bearing all associated costs and risks of transit. Unsold work remains the property of the artist and must be collected within fourteen (14) days following the auction’s conclusion. All costs and logistics for delivery and collection are the artist’s responsibility.

§5 INSURANCE AND LIABILITY

The artist is responsible for insuring the artwork during transit to and from Openhalle. Openhalle will insure the artwork against theft or damage from the time of its arrival and inspection at our venue until it is collected by the buyer or retrieved by the artist. Our liability is limited to the minimum bid price set for the artwork.

§6 USAGE RIGHTS The artist grants Openhalle non-exclusive permission to use images of the artwork for promotional activities, including but not limited to the Openhalle website, social media platforms, press releases, and digital or print catalogues related to the exhibition and auction.

§7 SELECTION AND DISPLAY OF ARTWORK

All submissions will be reviewed for inclusion in the online auction. Upon selection, artists will be notified whether their work has been chosen for one of two categories: a) Inclusion in the Online Auction only. b) Inclusion in both the Online Auction and the Physical Exhibition at the Openhalle venue. This determination will be made prior to the artist shipping their work.

§8 PRICING AND SALES POLICY

Artists shall set an estimated value and a binding minimum bid for their artwork. Openhalle reserves the right to discuss these amounts with the artist prior to the auction to ensure alignment with the market. The highest confirmed bid at or above the minimum constitutes the final sale price. Artists are strictly prohibited from bidding on their own work, either directly or via a third party. In case of a violation of this rule, the artist will be disqualified and shall owe Openhalle a penalty equivalent to 50% of the artwork’s estimated value.

§9 FEEDBACK POLICY

Due to the high volume of submissions, we are unable to provide individual feedback on entries.
